Central rights according to directive (EU) 2015/2302
Travelers will receive all important information about the package tour before the package tour agreement is concluded.
There is always at least one trader who is responsible for the correct delivery of all the travel services included in the agreement.
Travelers are given an emergency telephone number or information about a contact point where they can get in touch with the tour operator or travel agency.
Travelers can transfer the package tour to another person, with reasonable notice and possibly against payment of additional costs.
The price of the package tour can only be increased if special costs increase (e.g. fuel prices) and if this is expressly stipulated in the agreement, and under no circumstances later than 20 days before the start of the package tour. If the price increase exceeds 8% of the price of the package tour, the traveler can terminate the agreement. If the tour operator reserves the right to a price increase, the traveler has the right to a price reduction if the relevant costs decrease.
Travelers can terminate the agreement without payment of a termination fee and receive a full refund of all payments if any of the essential elements of the package, apart from the price, are significantly changed. If the trader responsible for the package tour cancels the package tour before the start of the package tour, the travelers are entitled to a refund and compensation, depending on the circumstances.
Travelers can terminate the agreement without payment of a termination fee before the start of the package tour in the event of extraordinary circumstances, e.g. if there are serious security problems at the destination which are likely to affect the package tour. Travelers can also terminate the agreement at any time before the start of the package tour against payment of an appropriate and justified termination fee.
If essential elements of the package tour cannot be delivered as agreed after the start of the package tour, the traveler must be offered suitable alternative arrangements at no additional cost.
Travelers may terminate the agreement without payment of a termination fee if services are not performed in accordance with the agreement and this significantly affects the delivery of the package tour and the tour operator fails to remedy the problem.
Travelers are also entitled to a price reduction and/or compensation if the travel services are not provided or are provided in a defective manner.
The tour operator must provide assistance if the traveler is in difficulty.
If the tour operator or, in some Member States, the intermediary goes bankrupt or becomes insolvent, the payments are refunded. If the tour operator or, where applicable, the intermediary goes bankrupt or becomes insolvent after the start of the package tour, and if the package tour includes transportation, the travelers' home transportation is guaranteed.
